1. Scope of Application
These General Terms and Conditions (hereinafter "GTC") apply to all participants (hereinafter "course participants") in courses offered by CodeFactory GmbH (hereinafter "CodeFactory"), unless otherwise agreed in individual cases.
2. Registration
CodeFactory accepts registrations for courses via email to office@codefactory.wien or by using the online registration forms for the respective course on its website.
Every registration received in this manner is binding. Participation by a person other than the registered course participant is only possible with the express written consent of CodeFactory.
3. Participation Requirements
CodeFactory is entitled to make participation in courses contingent upon the fulfillment of certain qualifications. The prerequisites for participation are published in the respective course description on the CodeFactory website. It is the course participant's responsibility to assess whether they meet the participation requirements.
4. Course Fee
The course fee is due immediately upon confirmation of registration or receipt of the invoice. For participants financed by third parties (e.g., employers, employment services, WAFF, etc.), confirmation of payment from the third party may be required to complete course registration. In this case, CodeFactory's General Terms and Conditions for external financing partners apply, unless otherwise agreed in writing.
If the participant pays the course fee themselves, payment must be made before the course begins (either in full or, where applicable, in agreed installments). Installment agreements must be signed by both parties to be valid.
5. Course Content
CodeFactory reserves the right to change or remove course content at any time, for both ongoing and completed courses.
6. Course Completion
Some course formats include an inherent examination component or conclude with a certification exam. The certification criteria are communicated at the beginning of a course and are accessible via the online learning management system. CodeFactory reserves the right to waive the issuance of certificates or confirmations of participation, as determined by the trainers or management. There is no legal entitlement to a certificate or confirmation of participation.
7. Right of Withdrawal under the Distance and Off-Premises Sales Act (FAGG)
Payment of the course fee is binding upon confirmation of registration for a course. Unless otherwise agreed, a payment period of 14 days applies.
Cancellations of booked events must be made in writing (by mail or email). The cancellation becomes effective on the day it is received by CodeFactory (postmark). The right of withdrawal under the FAGG applies:
Consumers within the meaning of the Consumer Protection Act have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the date of conclusion of the contract (registration).
If registration occurs less than two weeks before the course begins, the participant agrees to a shortened cancellation period until the day the course starts.
From the day the course starts, cancellation is no longer possible; therefore, 100% of the agreed course fees are due.
To exercise the right of withdrawal, the participant must inform CodeFactory of their decision to withdraw from the contract by means of a clear statement (e.g., by letter or email).
To meet the withdrawal deadline, it is sufficient for the notification of the exercise of the right of withdrawal to be sent before the deadline expires.
8. No-Show After Registration
In the event of a course purchase, even if the participant did not attend the course or participate in further communication, CodeFactory reserves the right to collect the full course fee.
9. Exclusion from Further Participation
CodeFactory may exclude participants from further participation in the course for important reasons. This includes, but is not limited to, personal misconduct of any kind, insufficient language or technical skills, and failure to meet the required minimum qualifications.
10. Postponement and Cancellation of Courses
In the event of staff illness or other unavoidable circumstances beyond our control, CodeFactory may postpone or cancel course dates. In this case, CodeFactory will promptly notify registered course participants in writing to the email address provided and offer the option to reschedule to a later course date at no additional charge (where applicable).
In the event of a postponement or cancellation, participants may also withdraw from the course and receive a full refund of their course fee.

Billing address
Social security number (optional, e.g., for AMS/WAFF funding)
Date of birth (optional, e.g., for AMS/WAFF funding)
Information about the desired course/content of your inquiry
The data will be used exclusively for processing your inquiry, course registration, or customer support.
5. Legal Basis for Processing
Processing is carried out on the following legal bases in accordance with Article 6 GDPR:
Article 6(1)(b) – for the performance of a contract or in order to take steps prior to entering into a contract
Article 6(1)(a) – based on your consent (e.g., newsletter or contact form)
Article 6(1)(f) – for the purposes of our legitimate interests (e.g., improving our services or IT security)
6. Storage and Retention Period
Your personal data will only be stored for as long as is necessary to fulfill the respective purpose or as required by statutory retention periods (e.g., tax law).
Once these purposes or periods no longer apply, the data will be deleted or anonymized.
7. Newsletter
If you subscribe to our newsletter, we will store your email address in order to send you regular information about new courses, promotions, and events.
You can unsubscribe at any time by emailing office@codefactory.wien.
8. Disclosure of Data to Third Parties
Your data will only be disclosed if this is necessary for the performance of the contract (e.g., to funding agencies such as AMS or WAFF), if you have given your explicit consent, or if there is a legal obligation to do so.
Your data will not be disclosed to other third parties for advertising or analysis purposes.

Our website uses cookies to ensure basic functionality and to improve the user experience. You can restrict or disable the use of cookies via your browser settings.
